Current Analysis IT Connection Terms and Conditions

This special offer is intended as an exclusive offer for buyers of IT equipment and telecom services. Current Analysis IT Connection reserves the final right to accept or deny access to this offer to any company or individual.

This Master Subscription Agreement (the "Agreement:) is made by and between Current Analysis, Inc. ("Current Analysis"), a Delaware Corporation, and ("Client"). The following Terms and Conditions which identify the Internet-based Online Platform ("Platform") and Analysis ("Analysis") ordered, subscription term, and other details of the subscription relationship is incorporated herein and made a part of this Agreement.

Content and Platform. Current Analysis agrees to provide Client with access to the online Platform and Analysis subject to the terms and conditions described. The Client assumes sole responsibility for the use made and results obtained from the Platform and Analysis, and the Client agrees that, by agreeing to these Terms and Conditions, the fees set forth reflect this allocation of responsibility and risk.

Allowed Access. Only authorized password holders ("Subscribers") of Client may have access to the Platform and Analysis under the terms and conditions defined herein. Each User shall receive a personal username and password. Access to the Platform is restricted to Users with registered passwords.

Rights. Ownership of all copyrights, trademarks, intellectual property rights, and other proprietary rights are retained by Current Analysis and/or its licensors or third-party providers.

DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY. There are no warranties which extend beyond the description on the face hereof. Access to the Platform and Analysis is provided to Client solely for use as a IT Buyer Intelligence and research tool and is not intended to suggest specific courses of action. All information in the Platform and Analysis has been obtained from sources Current Analysis believes to be reliable, but is in no way warranted by Current Analysis as to accuracy or completeness and should not be relied upon by Client, and Client agrees not to rely on this information for decision making purposes. All information contained in the Platform and Analysis is current as of the publication date; Current Analysis does not undertake to advise Clients as to any changes in figures or its opinions.

The information published and made available under this Agreement is not intended to support investment decisions or recommendations with respect to securities or any company and Current Analysis assumes no liability for decisions made, in whole or in part, on the basis of any information included in the Platform and Analysis. All information in the Platform and Analysis, and access to any Current Analysis IT Connection databases or networks, are provided on an "as is", "as available" basis.

Current Analysis, its licensors and third party information providers expressly disclaim all warranties, express or implied, statutory or otherwise, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness or adequacy of information. The total liability of Current Analysis and its employees arising out of this Agreement and the Platform and Analysis under all theories of liability shall be limited to the fees paid by Client to Current Analysis for the Platform and Analysis described herein. Client, Current Analysis, its licensors and third parties providing information or other input to the Platform and Analysis shall not be liable for consequential, indirect, special, incidental, or punitive damages. In addition, neither party shall be liable for any damages occurring by reason of any circumstances beyond its reasonable control. The Terms and Conditions of this Agreement shall survive the termination and/or expiration of the Subscription Term.

Assignment. Neither party may assign or otherwise transfer any right or obligation set forth in this Agreement (whether by operation of law or otherwise) without the other party’s prior written consent.

Governing Law. This agreement shall be governed and construed in accordance with the laws of the Commonwealth of Virginia.
